Terms and Conditions

Introduction

These Terms and Conditions govern the supply of photography services by Chris Ahern Imagery (“Photographer”) to clients (“Client”). By booking or using our services you accept these Terms. Photographer retains copyright in all images; Clients receive licences as set out below.

1. Services Provided

General Photography: portrait, corporate, event, product, and commercial shoots.

Sports Photography: match coverage, team photos, action sequences, event galleries, and media‑use packages. Deliverables, hours, and number of edited images are specified in each booking confirmation.

2. Fees, Deposits and Payment

A non‑refundable deposit (typically 20–50%) secures the booking; balance due prior to delivery of final files. Late payments incur interest and may suspend delivery. All prices are AUD and exclude GST unless stated.

3. Copyright and Licence

Photographer retains copyright under the Copyright Act 1968 (Cth). Clients receive a non‑exclusive, non‑transferable licence limited to the uses and duration purchased (e.g., Standard Business Use; Paid Advertising Licence 2 or 5 years). Any use beyond the licence (resale, stock, merchandising, paid campaigns outside the licence) requires a separate licence and fee.

4. Paid Advertising Licence Options

Select at booking: 2‑Year Licence A$395 or 5‑Year Licence A$995. Licences permit paid digital and OOH use only for channels and territory listed on the invoice. Extensions, territory additions, and exclusivity are available for additional fees.

5. Cancellation and Rescheduling

Client cancellations: deposit forfeited if cancelled within 48 hours of shoot. Photographer cancellations: full refund or reschedule. Weather or force majeure: reschedule or refund at Photographer’s discretion.

6. Sports Photography Specific Terms

  • Permissions: Client must secure venue, team and league permissions where required.

  • Minors: For under‑18s, Client must provide parental/guardian consent.

  • Accreditation: Photographer may require accreditation; Client to supply details in advance.

  • Club Use: Clubs may use images for internal communications and social media; commercial sponsorship or merchandising requires a paid licence.

7. Model and Property Releases

Client is responsible for obtaining releases unless Photographer is engaged to obtain them. Photographer may request permission to use images for portfolio and marketing unless a written embargo is paid for.

8. Liability and Indemnity

Photographer’s liability is limited to fees paid. Photographer is not liable for indirect or consequential loss. Client indemnifies Photographer for claims arising from Client’s use of images.

9. Privacy and Data

We collect contact and image data to provide services and comply with privacy laws. Images may be stored for portfolio use unless an embargo is agreed. See our Privacy Policy for details.

10. Dispute Resolution and Governing Law

These Terms are governed by the laws of Queensland, Australia. Parties will attempt mediation before litigation.
